Acceptance of these terms
By accessing or using TestMyTumor.org (the "Site"), you agree to these Terms of Service. If you do not agree, please do not use the Site.
What this site is
The Site is a free educational reference that describes genomic testing options that may be relevant to a given cancer type and stage, and provides an optional, anonymous survey so visitors can report back on what testing was actually offered or recommended by their care team. The Site is a starting point for a conversation with your oncologist, not a clinical tool, and it does not order tests, interpret results, or provide medical care.
Not medical advice
Nothing on the Site constitutes medical advice, diagnosis, or treatment. See our Medical Disclaimer, which is incorporated into these Terms by reference, for more detail. Always seek the advice of your physician or other qualified health provider with any questions about a medical condition or treatment.
No professional relationship
Your use of the Site, including the follow-up survey, does not create a physician-patient, therapist-patient, or other professional relationship between you and TestMyTumor.org or its creators.
Accuracy and "as is" basis
The Site and its content are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose, or non-infringement. Test names, descriptions, and specifications are drawn from publicly available sources and may contain errors or become outdated. We do not warrant that the Site will be uninterrupted, timely, secure, or error-free.
Limitation of liability
To the fullest extent permitted by law, TestMyTumor.org, its creators, and any contributors will not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of, or inability to use, the Site, including any decision made in reliance on information found here. This includes, without limitation, decisions about medical testing, treatment, or care.
Your use of the survey
The follow-up survey is intended to collect good-faith, honest responses about your own testing experience. Please do not submit information about another person without their knowledge, or submit false or misleading responses. In the optional free-text fields, please do not submit your name or other identifying health information or protected health information (PHI). We reserve the right to remove or disregard responses we reasonably believe to be spam, abusive, or not submitted in good faith.
Intellectual property
The Site’s original text, design, and organization are owned by TestMyTumor.org and its creators. You may print or share pages from the Site for your own personal, non-commercial use, such as bringing a printed summary to an appointment. You may not reproduce, republish, or redistribute substantial portions of the Site for commercial purposes without permission. Automated scraping, bulk copying, or data mining of the Site, including use of its content to train or improve artificial intelligence or machine learning models (such as large language models), is not permitted without our prior written permission.
Third-party names and trademarks
Test, laboratory, and company names referenced on the Site (for example, specific genomic or signature tests and their manufacturers) are the trademarks or service marks of their respective owners. Their use here is for identification and informational purposes only and does not imply any affiliation, sponsorship, or endorsement by those companies, nor does it imply our endorsement of them.
Links to other sites
The Site may link to third-party websites, such as a testing laboratory's own site, for further information. We do not control and are not responsible for the content, accuracy, or privacy practices of any third-party site.
Changes to the Site or these Terms
We may modify, suspend, or discontinue any part of the Site, and may update these Terms, at any time. Changes take effect once posted. Continued use of the Site after a change means you accept the updated Terms.
Governing law
These Terms are governed by the laws of the state of Texas, without regard to conflict-of-law principles.
